These Terms explain the rules for using PharmacogeneticTesting.ca, placing an order, submitting a sample, receiving a report, and using health- or medication-related information responsibly.

Scope

What these Terms cover

These Terms apply to PharmacogeneticTesting.ca, its online store, customer-support interactions, collection kits, laboratory services, and reports purchased through the website.

The website may use independent laboratories, couriers, payment processors, hosting providers, and other service providers to complete an order. Those providers may also apply operational terms that are relevant to their part of the service.

If a product page, consent document, refund policy, shipping policy, or privacy policy contains a more specific rule for a particular service, the more specific rule applies to that issue.

Terms governing website use and testing services

References to “you” mean the website visitor, purchaser, test participant, or authorized representative, as applicable. “We,” “us,” and “our” mean the operator of PharmacogeneticTesting.ca.

Section 01

Acceptance of these Terms

By accessing the website, creating an order, submitting information, activating a kit, or sending a sample for analysis, you agree to these Terms and the policies incorporated by reference.

If you do not agree, do not use the service, collect a sample, activate a kit, or submit a sample to the laboratory.

Section 02

Eligibility, age, and authority

You must have the legal capacity to enter into a contract and provide the required consent. A person ordering for another participant must have lawful authority to do so.

Testing involving a minor or a person who cannot provide their own consent requires consent from a parent, guardian, substitute decision-maker, or other person legally authorized under the law that applies.

Section 03

Nature and scope of the services

Products may include genetic, pharmacogenetic, metabolism, wellness, predisposition, methylation, longevity, microbiome, or other laboratory-supported reports described on the relevant product page.

Report scope differs by product. Ordering one test does not include genes, medications, conditions, traits, consultations, or services that are not identified in that product’s description.

Unless a product is expressly described as a legal or chain-of-custody service, it is not intended for court, immigration, employment, insurance, forensic, or identity purposes.

Section 04

Consent and sample authorization

You may submit only a sample that belongs to you or to a person for whom you have lawful authority and informed consent to arrange testing.

You must not collect, submit, test, or attempt to test another person’s sample secretly, deceptively, or without the permissions required by law and by the applicable consent form.

We or the laboratory may refuse, pause, or cancel testing when identity, authority, consent, sample ownership, or participant information cannot be reasonably confirmed.

Section 05

Orders, prices, taxes, and payment

Product descriptions and prices may be corrected or changed before an order is accepted. Prices are shown in the currency stated at checkout. Applicable taxes, delivery charges, return-shipping charges, courier costs, replacement-kit charges, and optional services may be added where disclosed.

An order confirmation acknowledges receipt of the order. We may reject or cancel an order because of payment failure, suspected fraud, product unavailability, an obvious pricing or description error, service restrictions, consent concerns, or another reasonable operational or legal issue.

When we cancel an order before a service is supplied, any amount paid for the cancelled portion will be handled under the Refund and Returns Policy and applicable law.

Section 06

Kit delivery and sample return

You are responsible for providing a complete and accurate delivery address, recipient name, telephone number, and email address. Delivery estimates are not guarantees and may be affected by couriers, postal services, weather, customs, remote locations, or events outside reasonable control.

Follow the return address and packaging instructions supplied with the specific kit. Different tests may use different laboratories or return locations. Sending a sample to an incorrect address may cause delay, damage, loss, or additional cost.

Section 07

Your collection responsibilities

You agree to:

  • Read and follow the collection, labelling, activation, storage, and return instructions;
  • Provide complete and accurate participant, medication, health, and order information;
  • Use the correct collection materials for the selected test;
  • Avoid contamination, substitution, mislabelling, or tampering;
  • Return the sample within any stated stability or expiry period; and
  • Keep order and tracking details until sample receipt is confirmed.

Incorrect or incomplete information may affect processing, report accuracy, delivery, or the ability to complete the service.

Section 08

Laboratory processing and turnaround

Published turnaround times are estimates, not guaranteed completion dates. Unless stated otherwise, laboratory turnaround begins only after the correct laboratory receives an acceptable, properly identified sample and all required information, consent, and payment.

Testing may be delayed by sample quality, quality-control review, repeat analysis, recollection, equipment issues, laboratory workload, shipping disruption, missing information, or circumstances outside reasonable control.

When analysis fails because of a confirmed laboratory error, a repeat analysis or recollection may be arranged without an additional testing fee. Charges may apply when failure results from collection, contamination, storage, labelling, shipping, or another cause outside laboratory control.

Section 09

Reports, interpretation, and medical limitations

Results are generally provided electronically. A report reflects the genes, variants, markers, organisms, or other information included in the selected test and detectable by the method used. It does not provide a complete assessment of every possible genetic, medication, health, or environmental factor.

  • A report is not a diagnosis, prescription, emergency service, or substitute for medical care.
  • Pharmacogenetic information does not determine by itself which medicine or dose is appropriate.
  • Do not start, stop, replace, or change a medication or dose without the prescribing professional.
  • A predisposition result does not confirm that a condition is present or will develop.
  • A negative or low-risk result does not eliminate all health risk.
  • Wellness, metabolism, methylation, longevity, and microbiome information may require professional interpretation.

Seek a qualified doctor, pharmacist, genetic counsellor, or other appropriate professional for individualized questions. Use local emergency services for urgent or emergency medical concerns.

Section 10

Privacy and genetic information

Personal, health, genetic, microbiome, order, and payment-related information is handled according to the applicable privacy notices and legal requirements.

Information may be shared with laboratories, payment processors, couriers, hosting providers, support providers, professional advisers, and other service providers only as reasonably required to provide, protect, administer, or comply with the service and the law.

Section 11

Permitted and prohibited use

You may use the website for lawful personal or authorized purposes. You must not:

  • Submit false, misleading, stolen, or unauthorized information or samples;
  • Use the service to violate privacy, consent, employment, insurance, human-rights, or other laws;
  • Interfere with website security, accounts, checkout, reports, or laboratory systems;
  • Copy, scrape, resell, reverse engineer, or commercially exploit website content without permission;
  • Impersonate another person or misrepresent authority to act for them; or
  • Use a report to harass, discriminate against, coerce, or harm another person.

Website content and intellectual property

Website text, graphics, design, product descriptions, reports, logos, downloads, and other content are owned by or licensed to the website operator or relevant service provider and are protected by applicable intellectual-property laws.

You may use your purchased report for personal and professional healthcare discussions. No other licence is granted except as expressly stated or required by law.

Section 13

Third-party services and links

The service may depend on independent laboratories, couriers, payment platforms, portals, or websites. We do not control every third-party system, schedule, policy, outage, or external page.

A link does not mean that we endorse every statement, product, or practice on the linked site. Review the relevant third party’s terms and privacy notices when using its services.

Section 14

Cancellations, returns, and refunds

Refund eligibility depends on the order stage, whether a kit has been prepared or dispatched, whether it has been opened or activated, whether a sample has been collected or submitted, and whether laboratory work or report preparation has begun.

Review the Refund and Returns Policy. Nothing in these Terms removes a cancellation, refund, replacement, or other remedy that cannot lawfully be excluded.

Section 15

Service disclaimers

To the maximum extent permitted by law, the website and services are provided on an “as available” basis. We do not promise uninterrupted website access, a particular medical decision, a specific result, reimbursement by an insurer, eligibility for a benefit, or a particular health or lifestyle outcome.

Scientific knowledge, gene-drug guidance, reference databases, laboratory methods, and professional recommendations may change. A report reflects the methods and knowledge used when it was produced.

Section 16

Limitation of liability

Nothing in these Terms excludes or limits liability or consumer rights that cannot be excluded or limited under applicable law.

Subject to that rule, and to the maximum extent permitted by law, we and our service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from website use, delivery delay, misuse of a report, decisions made without professional advice, or events outside reasonable control.

To the maximum extent permitted by law, total liability relating to a specific paid service will not exceed the amount paid for the affected service. This limit does not apply where the law prohibits it, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, personal injury, privacy breach, or another legally protected claim.

Section 17

Suspension, refusal, and termination

We may refuse, suspend, or terminate website access or an order when reasonably necessary to address unlawful activity, non-payment, fraud, security concerns, abusive behaviour, consent problems, unauthorized samples, operational restrictions, or a material breach of these Terms.

Sections that by their nature should continue—such as privacy, intellectual property, disclaimers, liability, governing law, and payment obligations—survive termination.

Section 18

Changes to services and Terms

We may update products, prices, methods, providers, website features, or these Terms. The updated date will appear at the top of this page.

Material changes apply prospectively unless law permits or requires otherwise. Terms in force when an order is accepted generally govern that order, together with any later change you expressly accept.

Section 19

Governing law and consumer rights

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, without limiting mandatory rights available under the consumer-protection or privacy law of your province or territory.

The courts of British Columbia have non-exclusive jurisdiction, except where applicable law gives you the right to bring a claim in another location or through another process.

Section 20

General contractual terms

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A delay in enforcing a right is not a waiver.

You may not transfer an order or contractual right where doing so would affect consent, sample identity, privacy, eligibility, or laboratory processing. We may assign service obligations as part of a lawful business transfer or provider arrangement, subject to applicable privacy and consumer law.

These Terms and the incorporated policies form the agreement concerning the website and purchased services, except for additional terms expressly accepted for a particular product.

Questions and legal notices

Use the Contact Support page for questions about these Terms, an order, consent, shipping, privacy, a sample, or a report.

Include your name, order number when applicable, province or territory, the page involved, and a concise description of the issue. Do not include unnecessary genetic, medical, payment-card, or account-password information in a general contact message.

Medication decisions require professional review

A pharmacogenetic report may support a conversation about medication response, but it does not replace the prescribing professional’s assessment of diagnosis, symptoms, dose, interactions, allergies, kidney or liver function, pregnancy, age, other medicines, and clinical history.
